Click Marketing General Terms & Conditions

Click Marketing Ltd owns the Click Marketing Terms & Conditions We are registered as Click Marketing Ltd.  

Proposals and Quotations

 Quotations are valid for 30 days.   The placement of an order for a service offered by Click Marketing constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions. It forms a Contract for Business between the client and Click Marketing.   When the client accepts the estimate or quotation, it indicates acceptance of the Terms & Conditions, and a deposit of 50% of the quoted fee will become immediately due. Work on the project will not commence until the 50% deposit has been received.   Unless expressly stated, all prices shall be in Dollars (USD). If additional duties or costs are introduced or changed after the conclusion of an Order, the Company shall be entitled to adjust the agreed prices accordingly.  

Fees and Payment Terms

The client is required to pay each invoice submitted by the Company within 14 Business Days of the invoice date. Payment is accepted by BACS, CHAPS, Cheque and Bank Transfer. All payments should state the invoice number clearly.   The client will be asked to provide a final project before the final invoice will be sent, and the remainder of the fees due will become payable. Release of the work carried out by Click Marketing on behalf of the client may not occur before funds have cleared.   An account is considered in default if it remains unpaid for 30 days from the invoice date. Click Marketing shall be deemed entitled to remove Click Marketing’s and/or the client’s material from the website or online publications until the amount due has been fully paid. Outstanding accounts include any and all unpaid monies due for services, including, but not limited to, hosting, domain registration, design and maintenance.   Removal of such materials does not relieve the client of their obligation to pay the due amount. Clients whose accounts become default agree to pay Click Marketing reasonable legal expenses and third-party collection agency fees to enforce these Terms and Conditions.   Click Marketing will not be held responsible for any project over-runs, whatever the cause. The estimated project duration should be deemed to be from the date that Click Marketing receives deposit funds in addition to all the received content.  

Supplied Content and Copyright

 When supplying text, images and other data to Click Marketing for inclusion in the client’s brochure/website or another medium, the client declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client or the rightful copyright or trademark owner.   When providing images, text, or any other data to Click Marketing, the client permits Click Marketing to use this material freely in pursuing and utilising the designs in Click Marketing’s portfolio unless stated differently.   If Click Marketing, or the client supply and provide an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement, or any other medium believing it to be copyright and royalty-free, which subsequently emerges to have such copyright or royalty usage limitations, the client will agree to allow Click Marketing to remove and/or replace the file.   Click Marketing retains the copyright of all graphic design work. This includes copy, concepts, ideas, proofs and illustrations (unless specifically released in writing) until all invoices are settled.   If multiple design concepts are submitted, only one concept will be supplied by Click Marketing to fulfil the contract. All other artwork designs remain the property of Click Marketing unless agreed in writing.  

Website Terms and Conditions

 Websites are designed using the client’s original content, final design brief and professional artistic direction, and design best practices.   Once the web design is complete, Click Marketing will allow the client the opportunity to review all work and provide the login details for the website.  

Website Revision Allowance

 Click Marketing will make one major set of changes in the review period. The review period is 1 week after submitting the website review notice to the client.   It is the client’s responsibility to ensure a comprehensive and timely review is made of the site. The client is to ensure all parties involved are consulted and that a representative gathers all the relevant feedback into one review response which must be submitted to Click Marketing. All changes must be noted for the entire website during the initial review.   Changes to the initial design are made as a one-off, and approval is required.   The client will be liable for additional out-of-scope fees if further changes are submitted after the initial review response. Click Marketing will charge the standard hourly rate fee for this work.   Upon completion, the client must advise Click Marketing if the website is to managed under a maintenance contract or given back to the client to manage.   Click Marketing supplies a WordPress “how-to” guide for basic troubleshooting should the client decide not to sign up for a maintenance contract.  

Design Credits

 The client agrees to allow Click Marketing to place all designs and the client logo on Click Marketing’s website for portfolio and demonstration purposes and to use any designs in its publicity unless agreed otherwise.  

Right of Refusal

 All advertising material must conform to the standards laid down by all relevant advertising standards authorities. Click Marketing will not include any text, images or other data it deems immoral, offensive, obscene or illegal in its designs. Click Marketing also reserves the right to refuse to include submitted material without providing a reason.   Any images and/or data that Click Marketing does include in good faith and then finds out that it contravenes these Terms and Conditions, the client is obligated to allow Click Marketing to remove the contravention without interference or penalty. Click Marketing will not be held responsible for any such data being included.  

Project Cancellation

 Once any one of the Click Marketing services has commenced, you may cancel the Services at any time by giving us 21 days’ notice with payment due until the expiry of the notice period.   If a client cancels and requests a refund on any order or part order before the project is finalised, then Click Marketing reserves the right to keep a per cent % of the deposit to cover work already done. If a client cancels or requests a refund for a project already completed, Click Marketing reserves the right to retain the full deposit to cover work already completed on the project.   Upon cancellation and refund request, Click Marketing reserves the right to all the content and will not send the final or draft design content to the client. The website design and already designed pages will be taken down and Click Marketing will not be held responsible for cancellations of Domain and Hosting fees.   If a client cancels without requesting a refund and does not want to proceed with the remainder of the project design. Click Marketing reserves the right to retain the 50% deposit to cover work already completed and submit the completed designs that fall within the 50% deposit received.   Domain and Hosting cancellation fees are not the responsibility of Click Marketing. These are controlled by the Hosting Company and the client’s responsibility when cancelling the services.  

Dissatisfaction with the Service

 If, for any reason, a client is not happy with the level of service received from Click Marketing, they must contact Click Marketing immediately at   You need to inform us of the following:

 Click Marketing reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions.   Click Marketing will not knowingly perform any actions to contravene these Terms and Conditions, and the client also agrees to be bound by these Terms & Conditions.
